These Terms form a legal agreement between You (“User”) including, if applicable, any legal entity which Users represent or act for; and Us, “LineHire Inc. (“LineHire”) and sets forth the terms and conditions governing user’s access to, and use of, this site (“Site”) and the services (“Services”) provided thereby, which enables Talent Scouts, employers, potential employees and general public to liaise and engage by using third party references. Please read these Terms carefully before using the site. By using the Site, Users agree to be bound by these Terms, as may be amended by LineHire from time to time. The changes to terms will be announced to the users in the written form and users will be advised to review the changes. If You do not agree to these Terms, please refrain from using the Site and Services.
The Services are intended for use by persons and entities that are of legal capacity to create a binding legal agreement and who are not barred from receiving services under the laws of their jurisdiction (“Legal Capacity”). Be aware that we are not and shall not be held liable for any breach of this requirement.
All pricing information is noted in US dollars and exclude VAT or other required taxes.
Users are required to create an account in order to use the Site. Users agree that all information provided by them is accurate, full, complete and up-to-date at all times. Users’ registration must be completed with their most current valid email address. Each registration is for a private User (or, if applicable, for the use of the legal entity on whose behalf the User accesses the Site) and Users are responsible for preventing unauthorized use of the accounts.
User agrees that LineHire relies on “User ID”s to confirm whether users accessing the Site and using its Services are authorized to do so. Users are solely responsible for any and all access to the Site or use of the Service by persons using their User ID. Please notify us immediately if You become aware that your User ID is being used without authorization.
We reserve the right to suspend or terminate User’s account at our sole discretion should such User fails to meet the requirements set forth above.
When Users access the Site and Services, they gain access to information and materials created by You and others (collectively, “Content”). Therefore:
Users are not allowed to revise Content created by others, and agree not to create, post or use any Content in any manner which may (i) infringe the copyright, trademark, trade secret, or other intellectual property or other proprietary right of others; (ii) violate the privacy, publicity, confidentially or other rights of third parties; (iii) be discriminatory, defamatory, obscene, threatening, abusive, or hateful, as determined by LineHire in our sole discretion; or (iv) be false or inaccurate. LineHire may terminate accounts or remove Content from the Site if we determine or suspect that those accounts or Content violate this User Agreement;
Users agree that information and opinions in Content created by third parties represent solely the thought of the author and are neither endorsed by LineHire or reflect our beliefs. We take no responsibility for Users’ exposure to Content on the Site whether it violates our content policies or not.
Users may register at the Site as (i) Clients or (ii) Talent Scouts. Users are required to keep their registration data up to date and make sure that their contact email addresses are valid. You can not use the same email address to register as both Client and Talent Scout, but you can register two different accounts with different email addresses.
(a) Clients may create a candidate LineHire Campaign (“LineHire Campaign”) by creating a campaign brief and paying the for the Campaign per instructions on the Site. The Campaign Brief must clearly specify the candidate requirements for the LineHire Campaign, such that Talent Scouts clearly know the rules and criteria on which the candidates’ resumes they submit for Campaigns will be judged. Clients agree to provide timely feedback and status updates on candidates submitted by using the app status update and messaging features.
(b) Talent Scouts may submit candidates’ resumes (“Submissions”) in the format specified by LineHire by following the instructions on the Site. Submissions must comply with the Campaign Brief. Submissions must meet the requirements specified in the job description and must be available to take a position if offered to him or her.
(c) The Clients are eligible for a credit in the event of unsatisfactory results. In the event of no submissions from Talent Scouts, or no candidates that the Client is interested in contacting, Clients may request credit of the Campaign Fee for a LineHire Campaign at any time up to one week after the conclusion of the LineHire Campaign. If Client has contacted any of the Candidates received for that Campaign, refund is no longer available. Credit card processing or other fees associated with transaction are not refundable or credited.
(e) Placement Fees (Success Fees)- LineHire incentivizes Talent Scouts by adding a Placement Fee which is payable in the event of a submitted candidate being hired (placed) by the employer in any role, whether as an employee or as a contractor. When a candidate submitted through LineHire is hired by the Employer for any role during the 12 month period following the Campaign conclusion, the Employer is required to alert LineHire of the hire and a Placement fee is due. LineHire invoices the employer for the Placement Fee amount on the candidate’s start date and payment is due at that time. LineHire will credit the Placement Fee should candidate guarantee period not be met. The guarantee periods are as follows:
- Placement Fee <$2,000- 14 days
- Placement Fee $2,000 to <$15,000 – 30 days
- Placement Fee $15,000 or more – 45 days
- Or as established in writing between LineHire and Client
Once the payment is made to LineHire by Client, LineHire will pay to the successful Talent Scout the advertised Placement Fee, as noted in each posted campaign. LineHire will pay the advertised Placement Fee amount, once the Client payment is received and the Guarantee Period has been completed with the Candidate still employed by the Client.
If multiple Talent Scouts refer the same person, the Talent Scout who submitted the Candidate first will be entitled to any Fee. If the client had substantial contact with the Candidate prior to receiving the name through LineHire during the preceding 12 months, the Candidate can be declined and the Talent Scout will not be eligible for the Fee.
(f) Interview Rewards-LineHire incentivizes Talent Scouts by rewarding them in the event their submitted candidate is interviewed. We define an Interview as the first meeting between the candidate and hiring manager, which is typically a face-to-face meeting, but maybe a video conference or telephone conference. Interview Reward amounts are advertised on each posted campaign.
If you are entitled to Placement Fee or other cash fee, you agree to be responsible at all times to report such income and pay all taxes to which You are subject under any applicable law or regulation. Notwithstanding, please note we reserve the right to withhold at source any amount for any Placement Fee You may be entitled to, at our sole discretion.
